| DECISION & ORDER ON MOTION |
Appeals from an order of the Supreme Court, Kings County, dated March 28, 2019. After the appeals were perfected, all briefs were filed, and the appeals were calendared, this Court was advised on January 29, 2020, that by order of the Supreme Court, Kings County, dated December 3, 2019, the underlying action had been dismissed insofar as asserted against the appellant PrimeFlight Aviation Services, Inc., and on January 31, 2020, that appellant filed a stipulation seeking to withdraw its appeal. By order to show cause dated February 13, 2020, the parties and their counsel were directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is denied.
Under the circumstances, sanctions are not warranted.
