Appeal from a judgment of the County Court, Westchester County, rendered May 16, 2013. Motion by the appellant for summary reversal on the ground that the jury notes have been lost, or, in the alternative, to enlarge the judgment roll to include certain documents.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for summary reversal is denied, as this issue has been raised in the appellant's brief on the appeal and will be determined upon the argument or submission of the appeal; and it is further,
ORDERED that the motion is otherwise denied.
