DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Kings County, dated May 12, 2016. By order to show cause dated February 11, 2020, the parties to the appeal were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action for failure to comply with a decision and order on motion of this Court dated December 4, 2019, which directed the appellant to serve and file a replacement record, on or before January 3, 2020.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated December 4, 2019.
