DECISION & ORDER ON MOTION

Walter Glibowski was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 9, 2003, under the name Walter John Glibowski. The Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts commenced this disciplinary proceeding pursuant to 22 NYCRR 1240.8 by the service and the filing of a notice of petition dated July 18, 2018, and a verified petition dated July 12, 2018, and the respondent served and filed a verified answer dated August 6, 2018. By decision and order on application dated October 1, 2018, this Court referred the issues raised to the Honorable Patricia M. DiMango, as Special Referee, to hear and report. The Grievance Committee subsequently moved to confirm a report of the Special Referee and for the imposition of such discipline upon Mr. Glibowski as this Court deemed appropriate. By opinion and order dated February 26, 2020, this Court granted the Grievance Committee's motion and suspended Mr. Glibowski from the practice of law for a period of two years (see Matter of Glibowski, 182 AD3d 137).

On the Court's own motion, it is

ORDERED that the opinion and order of this Court dated February 26, 2020, is recalled and vacated, and the above-entitled disciplinary proceeding is discontinued, in view of the death of Walter Glibowski, on February 6, 2020.
