Respondent having moved to dismiss the appeal taken herein from an order of the Supreme Court, Erie County, entered November 6, 2019, and appellant having applied for an extension of time to perfect the appeal,
Now, upon reading and filing the papers with respect to the motion and the application, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied, the notice of appeal from the order entered November 6, 2019, is treated as valid, and the appeal is deemed to be from the judgment entered November 18, 2019 (see CPLR 5520 [c]), and
It is further ORDERED that appellant's application is granted, and the time to perfect the appeal is extended to July 27, 2020, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
