An appeal having been taken to this Court from the judgment of the Supreme Court, New York County, rendered on or about April 17, 2019, And an order of this Court having been entered on November 21, 2019 (M-7704), inter alia, granting defendant leave to prosecute said appeal as a poor person, and assigning Christina Swarns, Esq., Office of Appellate Defender, as counsel to prosecute the appeal; And an order of this Court having been entered on March 5, 2020 (M-367), granting defendant the identical poor person relief, with the exception of assigning Janet E. Sabel, Esq., The Legal Aid Society, as counsel to prosecute the appeal, And defendant-appellant having moved to vacate this Court's March 5, 2020 order of assignment (M-367), Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted and this Court's order of assignment, entered March 5, 2020 (M-367), is hereby vacated.
