DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Nassau County, rendered May 8, 1991, which was dismissed as abandoned by decision and order on motion of this Court dated May 15, 2000. Motion by the appellant pro se to vacate the dismissal of the appeal, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
