DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Westchester County, rendered January 9, 2018. Motion by the appellant pro se, inter alia, to relieve counsel assigned to prosecute the appeal and for the assignment of new counsel, to dismiss the underlying case against him, and to be furnished with transcripts of the grand jury proceedings and other transcripts to aid in the preparation of a pro se supplemental brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to be provided with the transcript of the grand jury proceedings is granted to the extent that the District Attorney shall file the transcript of the grand jury proceedings, if any, under seal, with the Clerk of this Court, for in camera review by the panel of Justices assigned to hear the appeal, and that transcript shall remain sealed upon delivery; and it is further,

ORDERED that the branch of the motion which is to be provided with other transcripts is denied without prejudice to renew upon proper papers specifying the date of the proceedings and the issues to be raised in connection with those proceedings; and it is further,

ORDERED that the motion is otherwise denied.
