| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Nassau County, dated February 2, 2017. Motion by the respondent to amend the caption to substitute Rachel Dugan, as the personal representative for the estate of the deceased appellant, Todd Dugan, to vacate the automatic stay of proceedings arising from the death of the deceased appellant, Todd Dugan, and to dismiss the appeal on the ground that it has been rendered academic.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is dismissed without prejudice to renew on proper papers, including proof of service of the motion upon the personal representative for the estate of the deceased appellant, Todd Dugan, and, if so advised, a copy of the settlement agreement signed by the personal representative for the estate of the deceased appellant, Todd Dugan, which is referenced in the respondent's motion papers.
