DECISION & ORDER ON MOTION

2019-1189 S CR
The People of the State of New York, Respondent, v Kamil Podmalovsky, Appellant.

Motion by appellant to compel the People to settle the trial transcript and the filing of a return, and to enlarge the time to perfect the appeal, on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency District, rendered March 7, 2019. Separate motion by the People to file late opposition to the motion.

Upon the papers filed in support of the respective motions and the papers filed in opposition thereto, it is

ORDERED that the motions are consolidated for disposition; and it is further

ORDERED that the People's motion to file late opposition is granted and the opposition is deemed filed; and it is further,

ORDERED that the branches of appellant's motion to compel settlement of the transcript and to compel the People to file a return are denied as moot, as both have been filed with the court; and it is further

ORDERED that the branch of appellant's motion to enlarge the time to perfect the appeal is granted, and the appeal shall be perfected on or before July 20, 2020, by filing a digital copy of the brief, with proof of service, onto the court's digital portal, Records, Briefs & Motions Drop Off, found on the court's website at:

https://nycourts.sharepoint.com/sites/AT2-DCS/SitePages/Home.aspx.

Upon the full re-opening of the court, the parties will be directed to file hard copies of such briefs with the court.
