The People of the State of New York, Respondent, v Marco Tavira Martinez, Appellant.

Motion by Janet E. Sabel, Esq., counsel assigned to represent appellant on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered September 12, 2017, in effect, to be relieved as counsel on the ground that the appeal has been rendered moot by the vacatur of appellant's conviction.

Upon the papers filed in support of the motion and no papers having been filed in response thereto, it is

ORDERED, on the court's own motion, that the appeal is dismissed as moot; and it is further,

ORDERED that the motion by assigned counsel, in effect, to be relieved as counsel is granted.
