DECISION & ORDER ON MOTION

Fieldbridge Associates, LLC, Respondent, v C. Robinson, Tenant, and S. Robinson-Green, Appellant

Motion by appellant to vacate the order of this court dated January 9, 2020, which dismissed the appeal, and, in effect, a motion pursuant to CPLR 5520(a) for leave to cure an omission in filing a notice of appeal from an order of the Civil Court of the City of New York, Kings County, entered October 1, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion to vacate the dismissal is granted and the order dated January 9, 2020, dismissing the appeal on the court's own motion is hereby vacated; and it is further,

ORDERED on the court's own motion that the appeal shall be perfected on or before July 20, 2020, by filing a digital copy of the brief, with proof of service, onto the court's digital portal, Records, Briefs & Motions Drop Off, found on the court's website at:

https://nycourts.sharepoint.com/sites/AT2-DCS/SitePages/Home.aspx.

And it is further,

ORDERED that upon the full re-opening of the court, the parties will be directed to file hard copies of such briefs with the court; and it is further,

ORDERED that the notice of appeal is deemed timely filed.
