| DECISION & ORDER ON MOTION |
2020-00421
Philip Jaget, appellant,
v Clarice Jaget, respondent.
(Index No. 177/2019)
Appeals from two orders of the Supreme Court, Dutchess County, dated October 8, 2019, and October 17, 2019, respectively. Motion by the appellant, inter alia, to consolidate the appeals, to extend the time to perfect the appeals, and, in effect, to stay enforcement of so much of the order dated October 8, 2019, as stayed all proceedings, except for a certain hearing, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal from the order dated October 17, 2019, is dismissed, without costs or disbursements, on the ground that no appeal lies from an order denying reargument; and it is further,
ORDERED that the branches of the motion which are to consolidate the appeals and to extend the time to perfect the appeal from the order dated October 17, 2019, are denied as academic; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeal from the order dated October 8, 2019, is denied as unnecessary as the time to perfect the appeal does not expire until September 9, 2020 (see ADM 2020-0707); and it is further,
ORDERED that the motion is otherwise denied.
RIVERA, J.P., BALKIN, HINDS-RADIX and LASALLE, JJ., concur.
