Motion by appellant for leave to reargue an appeal from an order of the Civil Court of the City of New York, Richmond County, entered September 14, 2016, which was determined by decision and order of this court dated May 10, 2019 (63 Misc 3d 152[A], 2019 NY Slip Op 50752[U]).
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and, upon reargument, the decision and order of this court dated May 10, 2019 (63 Misc 3d 152[A], 2019 NY Slip Op 50752[U]) is recalled and vacated, and a new decision and order substituted therefor (see appeal No. 2016-3083 RI C, decided simultaneously herewith).
