DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Christian Florantine, Appellant.

Motion by appellant's assigned counsel for leave to withdraw the appellant's brief previously submitted and, in effect, to serve and file a replacement brief on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered November 1, 2016.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, the appellant's brief is deemed withdrawn, and the replacement appellant's brief shall be served and filed within 45 days of the date of this decision and order on motion; and it is further,

ORDERED that respondent may, if so advised, serve and file a replacement respondent's brief within 21 days after the replacement appellant's brief is due to be filed pursuant to this decision and order on motion.
