Appeal from an order of the Supreme Court, Kings County, dated October 2, 2019. Motion by the appellant, in effect, to enlarge the record to include certain documents.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the matter is referred to the Supreme Court, Kings County, to report on whether it considered (1) the appellant's first demand for documents dated August 16, 2019, (2) the affirmation of service of that demand dated August 19, 2019, (3) the email exchange between the appellant and the respondent's counsel dated August 21, 2019, through September 9, 2019, and (4) the respondent's response, dated September 23, 2019, to the appellant's first demand for documents dated August 16, 2019, in connection with the motion that was determined by the order dated October 2, 2019; the Supreme Court, Kings County, shall file its report to this Court with all convenient speed; and it is further,
ORDERED that the motion is held in abeyance in the interim.
