| DECISION & ORDER ON MOTION |
Motion by the respondents to dismiss an appeal from an order of the Supreme Court, Kings County, dated August 12, 2016, on the ground that it has been rendered academic or, in the alternative, inter alia, to hold the appeal in abeyance pending determination of a related appeal, under Appellate Division Docket No. 2018-14998. By decision and order on motion of this Court dated January 11, 2019, as amended January 14, 2019, the branch of the motion which was to hold the appeal in abeyance pending determination of the appeal pending under Appellate Division Docket No. 2018-14998 was granted, and the branch of the motion which is to dismiss the appeal was held in abeyance in the interim.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied.
