Appeal from an order of the Supreme Court, Queens County, dated September 5, 2019. Motion by Levine & Grossman for leave to withdraw as counsel for the appellant. Application by the appellant pursuant to 22 NYCRR 1250.9(b) to extend the time to perfect the appeal.
Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, on or before September 22, 2020, Levine & Grossman shall upload, through the digital portal on this Court's website, a digital copy of an attorney affirmation or affidavit delineating the specific reasons why Levine & Grossman cannot continue to represent the appellant, with proof of service of the affirmation or affidavit on the appellant; the appellant, if so advised, may file an affidavit in response to the attorney affirmation or affidavit on or before October 2, 2020, with proof of service thereof, by uploading a digital copy of the affidavit through the digital portal on this Court's website or via regular mail; the attorney affirmation or affidavit and the appellant's affidavit in response, if any, shall be filed under seal and shall continue to be sealed upon filing; and it is further,
ORDERED that the motion and the application are held in abeyance in the interim.
