In the Matter of Leonna Sylvester,

respondent-appellant, v Jason Goffe,

appellant-respondent.

(Docket No. U-7134-16/19I)

DECISION & ORDER ON MOTION

Appeal and cross appeal from an order of the Family Court, Nassau County, dated February 7, 2020. Motion by Leonna Sylvester, inter alia, to recall and vacate so much of a decision and order on motion of this Court dated May 18, 2020, as dismissed her appeal on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 5-B and leave to appeal had not been granted, and to reinstate her appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.

DILLON, J.P., BALKIN, COHEN and WOOTEN, JJ., concur.
