| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Suffolk County, dated June 26, 2018. Motion by the respondent to strike the reply brief for the appellant Roger Rowe. Separate motion by the appellant Roger Rowe, in effect, to interpose a counterclaim.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is,
ORDERED that the respondent's motion is granted, the reply brief for the appellant Roger Rowe is stricken, and or before September 21, 2020, the appellant Roger Rowe shall serve and file a replacement brief which complies with the rules of the Appellate Division (see 22 NYCRR 1250.8); and it is further,
ORDERED that the motion by the appellant Roger Rowe is denied.
