DECISION & ORDER ON MOTION

2019-1859 S CR
The People of the State of New York, Respondent, v Daniel Desz, Appellant.

Motion by appellant to: compel the court to settle the trial transcript and the file a return; extend the time to perfect the appeal and extend the stay of the suspension of appellant's license, on an appeal from a judgment of conviction of the District Court of Suffolk County, Traffic and Parking Violations Agency, rendered November 13, 2019.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branches of appellant's motion to compel settlement of the transcript and compel the court to file a return are granted, and the District Court of Suffolk County, Traffic and Parking Violations Agency District shall, within 21 days of service by appellant upon it of a copy of this decision and order on motion, settle the minutes and forward the record to this court; and it is further

ORDERED that the branch of appellant's motion to extend the time to perfect the appeal is granted, and the appeal shall be perfected on or before October 30, 2020, by filing a digital copy of the brief, with proof of service, onto the court's digital portal, Records, Briefs & Motions Drop Off, found on the court's website at:

https://nycourts.sharepoint.com/sites/AT2-DCS/SitePages/Home.aspx.

The parties will be directed at a later date to file hard copies of such briefs with the court; and it is further

ORDERED that the branch of the motion seeking a stay of the suspension of appellant's license is granted, and appellant shall serve a copy of this decision and order on motion upon the New York State Department of Motor Vehicles.
