2019-12158 In the Matter of Mindy Erber, respondent, v Gregory Erber, appellant. (Docket No. F-10690-2014/2017C/D/E/F/I)
| DECISION & ORDER ON MOTION |
Appeal by Gregory Erber from an order of the Family Court, Westchester County, dated October 7, 2019. By scheduling order of this Court dated March 13, 2020, the appellant's time to perfect the appeal was extended until April 8, 2020, and pursuant to administrative order ADM 2020-0506 and Executive Order [Cuomo] No. 204 that deadline was extended until June 22, 2020. The appellant has failed to perfect the appeal.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.3[b][2]) and prior order of the Court.
MASTRO, J.P., DILLON, LEVENTHAL and CHRISTOPHER, JJ., concur.
