| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Orange County, dated July 3, 2019. Motion by the appellant to stay enforcement of the judgment, pending hearing and determination of the appeal. Separate motion by the appellant to strike stated portions of the respondent's appendix and the respondent's brief on the ground that they contain or refer to matter dehors the record, and for an award of costs.
Upon the papers filed in support of the motion to stay enforcement of the judgment and the papers filed in opposition thereto, and upon the papers filed in support of the motion, inter alia, to strike stated portions of the respondent's appendix and the papers filed in opposition thereto, it is
ORDERED that the motion to stay enforcement of the judgment is denied; and it is further,
ORDERED that the motion, inter alia, to strike stated portions of the respondent's appendix is dismissed for failure to pay the motion filing fee (see CPLR 8022[b]).
