Appeal from an order of the Supreme Court, Nassau County, entered January 29, 2020. Motion by Flanzig & Flanzig, LLP, for leave to withdraw as counsel for the appellant and, in effect, to extend the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, on or before October 4, 2020, Flanzig & Flanzig, LLP, shall upload, through the digital portal on this Court's website, a digital copy of an attorney affirmation or affidavit delineating the specific reasons why Flanzig & Flanzig, LLP, cannot continue to represent the appellant, with proof of service of the affirmation or affidavit on the appellant; the appellant, if so advised, may file an affidavit in response to the attorney affirmation or affidavit on or before October 18, 2020, with proof of service thereof on Flanzig & Flanzig, LLP, by uploading a digital copy of the affidavit through the digital portal on this Court's website or via regular mail; the attorney affirmation or affidavit and the appellant's response, if any, shall be filed under seal and shall continue to be sealed upon filing; and it is further,
ORDERED that the motion is held in abeyance in the interim.
