DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for leave to prosecute an appeal from an order of the Supreme Court, Nassau County, entered March 8, 2019, as a poor person. By decision and order on motion of this Court dated May 8, 2020, the appellant's time to file the notice of appeal, which was timely served, was extended until July 7, 2020.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appellant's time to comply with the decision and order on motion of this Court dated May 8, 2020, is extended and on or before October 28, 2020, the appellant shall file the notice of appeal from the order entered March 8, 2019, with the Clerk of the Supreme Court, Nassau County, and file proof of filing with this Court via email at [email protected]; and it is further,

ORDERED that the motion is dismissed without prejudice to renew after the notice of appeal is filed.
