DECISION & ORDER ON MOTION

Motion by Thomas R. Villecco, Esq., counsel assigned to represent appellant on an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered September 13, 2016, to be relieved of representing appellant on the appeal, and to have other counsel substituted.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to relieve assigned counsel of representing appellant on the appeal is denied; and it is further,
ORDERED that on the court's own motion, appellant is granted leave to file a supplemental brief if he be so disposed, within 30 days from the date counsel files appellant's brief with the court; and it is further,
ORDERED on the court's own motion, that the matter is remitted to the District Court, for a hearing to determine which trial and hearing exhibits, if any, are missing from the record, and to determine whether missing exhibits, if any, can be reconstructed. The District Court shall file its report with all convenient speed.
