| ORDER TO SHOW CAUSE |
Appeals from a judgment of the Supreme Court, Rockland County, rendered August 3, 2011, under Ind. No. 97-00175, and an order of the same court dated March 3, 2011, issued pursuant to CPL 440.46, under Ind. No. 96-00316. By decisions and order on motions of this Court dated July 9, 2012, and October 25, 2012, the appellant's brief was stricken and the appellant was directed to serve and file a replacement brief on or before December 27, 2012. The appellant has not yet filed the replacement brief.
On the Court's own motion, it is
ORDERED that the appellant is directed to show cause before this Court why an order should not be made and entered dismissing the appeals on the ground that the appellant has abandoned the appeals, by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before October 23, 2020; and it is further,
ORDERED that the Clerk of this Court or her designee is directed to serve a copy of this order to show cause upon the appellant at his last known place of residence or, if he is imprisoned, at the institution in which he is confined, and upon the attorney who last appeared for him, and upon the District Attorney, by ordinary mail pursuant to CPL 470.60(2).
