On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated September 18, 2020, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Appeal from a decision of the Supreme Court, Nassau County, entered August 8, 2019. Motion by the respondent to dismiss the appeal on the ground that no appeal lies from a decision or, in the alternative, to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the notice of appeal from the decision is deemed to be a notice of appeal from an order of the Supreme Court, Nassau County, entered September 6, 2019 (see CPLR 5512[a]), on or before October 13, 2020, the appellant shall serve a supplemental record containing the order entered September 6, 2019, and upload a digital copy of the supplemental record, with proof of service thereof, through the digital portal on this Court's website, and the appellant shall file an original and five hard copies of the supplemental record in accordance with any applicable administrative order or other order to be issued by the Court; and it is further,
ORDERED that the branch of the motion which is to dismiss the appeal is denied; and it is further,
ORDERED that the branch of the motion which is to extend the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is extended, on or before November 12, 2020, the respondent shall serve the respondent's brief and upload a digital copy of the respondent's brief, with proof of service thereof, through the digital portal on this Court's website, and the respondent shall file an original and five hard copies of the respondent's brief in accordance with any applicable administrative order or other order to be issued by the Court.
