DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Suffolk County, rendered August 24, 2018. Motion by the respondent, inter alia, to reconstruct the respondent's Exhibit 22 at trial and, in effect, to extend the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to reconstruct the respondent's Exhibit 22 at trial is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,

ORDERED that the branch of the motion which is, in effect, to extend the respondent's time to serve and file a brief is denied as academic as the respondent timely served and filed a brief; and it is further,

ORDERED that the motion is otherwise denied.
