Appeal from an order of the Supreme Court, Queens County, entered June 7, 2019. By decision and order on motion of this Court dated June 15, 2020, the respondent's motion to dismiss the appeal was denied, on condition that on or before August 14, 2020, the appellant serve and file a supplemental record via NYSCEF containing the respondent's exhibits 1 through 10 which were admitted into evidence at the framed-issue hearing. The appellant failed to file the supplemental record.
On the Court's own motion, it is
ORDERED that the parties are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled matter for failure to comply with the decision and order on motion of this Court dated June 15, 2020, by filing a digital copy of an affirmation or affidavit on that issue, with proof of service thereof, via NYSCEF, on or before November 6, 2020; and it is further,
ORDERED that the Clerk of this Court, or her designee, is directed to serve a copy of this order to show cause upon the parties, by uploading a copy of this order to show cause to the NYSCEF system.
