An appeal and cross appeal having been taken herein from an order of the Family Court, Jefferson County, entered August 27, 2019 (appeal No. 1), and appeals having been taken herein from orders of the Family Court, Jefferson County, entered August 5, 2020 (appeal No. 2), and August 28, 2020 (appeal No. 3), and appellant Derek Johnson having moved for an order removing the appeal and cross appeal from the calendar for the October 2020 term of Court, consolidating the appeals, and extending the time to perfect the cross appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks the removal of the appeal and cross appeal from the calendar is granted, and

It is further ORDERED that the motion insofar as it seeks the consolidation of appeal No. 1 with appeal Nos. 2 and 3 is denied, and

It is further ORDERED that the motion insofar as it seeks an order consolidating appeal Nos. 2 and 3 is dismissed as unnecessary (see 22 NYCRR 1250.9 [f] [3]), and the appeals shall be perfected by electronic filing, and

It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the cross appeal is granted on the condition that appeal Nos. 1, 2, and 3 are perfected on or before November 2, 2020, and, if so perfected, the appeals shall be placed on the same day calendar during the term of Court commencing February 22, 2021, to be heard together.
