DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Kings County, dated July 17, 2020. Motion by the respondent to dismiss the appeal on the ground that no appeal lies as of right from an interlocutory order in a proceeding pursuant to CPLR article 78. Cross motion by the appellant, in effect, for leave to appeal to this Court from the judgment dated July 17, 2020.

Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that cross motion is denied as unnecessary as the judgment is appealable as of right.
