Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to dismiss the appeal is denied with leave to renew in a responsive brief, and
It is further ORDERED that the motion insofar as it seeks an extension of time to file and serve a brief is granted and the time is extended to November 19, 2020 and
It is further ORDERED that the appeal is removed from the Court's December 3, 2020 day calendar, and is added to the calendar for the term of this Court commencing January 11, 2021.
