Appeal and cross appeal from a judgment of the Supreme Court, Suffolk County, entered May 22, 2017. Motion by the appellant-respondent to strike the portions of the parties' briefs regarding JAVE Properties Corp. on the ground that the issues concerning that entity have been rendered academic.
