| DECISION & ORDER ON MOTION |
Appeal from a decision of the Supreme Court, Queens County, dated December 6, 2019, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the appellant, in effect, for summary reversal. Separate motion by the appellant pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeal, to extend the time to perfect the appeal, and, in effect, for summary reversal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion, in effect, for summary reversal is dismissed for failure to pay the motion filing fee (see CPLR 8022[b]); and it is further,
ORDERED that the branch of the motion which is pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeal is denied; and it is further,
ORDERED that the branches of the motion which are to extend the time to perfect the appeal and, in effect, for summary reversal are denied as academic.
