Pierre J. Renelique MD, P.C., as Assignee of Lopcy, Rene Jr., Appellant, v United Services Automobile Association, Respondent.

Appeal from an order of the Civil Court of the City of New York, Kings County, entered November 14, 2018. After the appeal was perfected and calendared, this Court was advised that the underlying action had been settled, and a Stipulation of Settlement and Discontinuance was executed on July 15, 2019, more than a year earlier. By order to show cause dated September 10, 2020, the parties and their counsel were directed to show cause before this Court why an order should or should not be made and entered imposing sanctions, if any, against them pursuant to 22 NYCRR 730.3(c) as this Court may deem appropriate.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion is denied.

Under the circumstances, sanctions are not warranted.
