| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by Frank E. Redl for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Redl was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 19, 1983. By decision and order on motion of this Court dated August 25, 2003, in a disciplinary proceeding, under Appellate Division Docket No. 2001-00582, Mr. Redl was suspended from the practice of law for a period of five years, commencing September 11, 2003 (see Matter of Redl, 308 AD2d 256). By opinion and order of this Court dated December 27, 2004, in a disciplinary proceeding, under Appellate Division Docket No. 2004-00681, Mr. Redl was disbarred based upon his default in answering a petition in a disciplinary proceeding, effective immediately, and his name was stricken from the roll of attorneys and counselors-at-law (see Matter of Redl, 14 AD3d 60).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied.
We find that Frank E. Redl does not demonstrate the requisite character and fitness to practice law.
