ECISION & ORDER ON APPLICATION

Application by the defendant pursuant to CPL 245.70(6) to vacate or modify a ruling of a Justice of the Supreme Court, Suffolk County, as set forth in two protective orders of that Court both dated October 30, 2020.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application pursuant to CPL 245.70(6) is denied to the extent that it seeks review of the portion of the protective orders relating to the name, address, contact information or statements of a person, and is otherwise dismissed; and it is further,

ORDERED that Exhibits A and C annexed to papers filed by the defendant in support of the application pursuant to CPL 245.70(6) and the documents submitted under seal by the People in connection with this application pursuant to CPL 245.70(6) are deemed to be filed under seal, and shall continue to be sealed.

The Supreme Court's ruling relating to the name, address, contact information or statements of a person was a provident exercise of discretion (see People v Nash, 179 AD3d 982, 984; People v Beaton, 179 AD3d 871, 874). The defendant's contentions concerning the portion of the protective orders not relating to the name, address, contact information or statements of a person have not been considered, and the application is dismissed to the extent that it seeks review of those portions of the protective orders (see CPL 245.70[6]).
