The People of the State of New York, Respondent, v Heriberto Echevarria-Acevedo, Jr., Appellant.

Motion by appellant on appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered January 22, 2019, to hold the appeal in abeyance pending the filing and determination of a motion to vacate the conviction before the District Court.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted, and the appeal is held in abeyance for 90 days for the determination of appellant's motion to vacate the conviction by the District Court of Suffolk County, First District.
