Spine Care of NJ, PC as Assignee of Yosef Elisha, Respondent, v Geico General Ins. Co., Appellant.

Motion by appellant to vacate the order of this court date September 21, 2020, which dismissed appeal from an order of the Civil Court of the City of New York, Kings County, entered September 23, 2019 and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and the order dismissing the appeal is vacated on condition that the appeal be perfected on or before January 8, 2021; and it is further,

ORDERED that in the event the appeal is not perfected by January 8, 2021, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal and may serve the appellant in person.
