DECISION & ORDER ON MOTION

Appeal by Anthony C. from an order of the Family Court, Queens County, dated September 23, 2019. By decision and order on motion of this Court dated October 2, 2020, the appellant was directed to serve and file an affidavit or affirmation containing certain material or move for leave to prosecute the appeal as a poor person and for the assignment of counsel, within 30 days after the date of the decision and order on motion. The decision and order on motion of this Court dated October 2, 2020, also provided that if none of the actions described therein had been taken within 30 days of the date of the decision and order on motion, the appeal might be dismissed, without further notice.

Now, on the Court's own motion, it is

 ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion of this Court dated October 2, 2020 (see 22 NYCRR 670.3[b]).
