Appeal from a judgment of the Supreme Court, Nassau County, rendered January 28, 2019. Motion by the appellant for the Court to take judicial notice of certain proceedings in the above-entitled action, or, in the alternative, to enlarge the judgment roll to include certain material related to those proceedings.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is for the Court to take judicial notice of proceedings is granted, and this Court shall take judicial notice of the respondent's motion to vacate the judgment pursuant to CPL 440.10, the appellant's affirmation in support of the motion, and the order of the Supreme Court, Nassau County, dated July 15, 2020; and it is further,
ORDERED that the motion is otherwise denied as academic.
