DECISION & ORDER ON
MOTION FOR REINSTATEMENT

Motion by James D. Castelli for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Castelli was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on September 26, 1990, under the name James E. Daguanno, and subsequently his name was changed to James D. Castelli on the roll of attorneys and counselors-at-law. By decision and order on motion dated March 26, 2014, this Court authorized the Grievance Committee for the Tenth Judicial District to institute and prosecute a disciplinary proceeding against Mr. Castelli, and the issues raised were referred to the Honorable Georgia Tschiember, as Special Referee, to hear and report. By opinion and order of this Court dated July 1, 2015, Mr. Castelli was suspended from the practice of law for a period of three years, commencing July 31, 2015. By decision and order on motion dated February 15, 2019, this Court denied Mr. Castelli's first motion for reinstatement.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is held in abeyance, and the matter is referred to a Committee on Character and Fitness to investigate and report on James D. Castelli's character and fitness to practice law.
