Appeal from an order of the Supreme Court, Nassau County, dated March 17, 2017, and appeal and cross appeal from an order of the same court dated December 5, 2017. Motions by Vincent W. Ansanelli III, as administrator of the estate of Thomas Barr IV to be substituted for the deceased plaintiff, Thomas Barr IV, to amend the caption accordingly, and to withdraw the appeals. Application by the respondents-appellants to withdraw the cross appeal from the order dated December 5, 2017.
Upon the papers filed in support of the motions and the papers filed in relation thereto, and upon the papers filed in support of the application and no papers having filed in opposition or in relation thereto, it is
ORDERED that the motions and the application are denied as academic as the appeals and cross appeal have been deemed dismissed (see 22 NYCRR 1250.10[a]).
