Defendant having moved pursuant to CPL 460.10 (6) to extend the time to serve a notice of appeal from a judgment of the Onondaga County Court, rendered October 18, 2019,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the notice of appeal filed in the Onondaga County Clerk's Office on October 18, 2019, for indictment number 2019-0134-1, which failed to list indictment number 2018-0432-1, shall be treated as valid as to the judgments rendered October 18, 2019, pursuant to CPL 460.10 (6), and
It is further ORDERED that the motion is granted.
MEMORANDUM: The notice of appeal entered October 18, 2019, which was served on the District Attorney's Office on October 18, 2019, is deemed timely served.
