| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Kings County, dated November 27, 2018. Motion by the appellant to extend the time to serve and file a supplemental appellant's appendix as directed by a decision and order on motion of this Court dated October 30, 2020, and to waive certification of the appellant's supplemental appendix pursuant to 22 NYCRR 1250.7(g). Separate motion by the appellant for leave to include certain documents in and to waive certification of the appellant's supplemental appendix pursuant to 22 NYCRR 1250.7(g) regarding those documents.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motions are granted, and on or before February 24, 2021, the appellant shall serve a supplemental appellant's appendix containing the document titled "Attorney Affirmation of Service & Fees" dated November 16, 2018, as well as Exhibits A through C which were annexed to the document titled "Attorney Affirmation of Service & Fees" dated November 16, 2018, and the document titled "Counsel Fee Application on Behalf of Plaintiff" signed by Brian D. Perskin, with annexed exhibits, including the letter retainer agreement dated October 22, 2015, and billing statements, and upload a digital copy of the supplemental appellant's appendix, with proof of service thereof, through the digital portal on this Court's website, and the appellant shall file an original and five hard copies of the supplemental appellant's appendix in accordance with any applicable administrative order or other order to be issued by the Court.
