DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Kings County, dated March 6, 2020. Motion by King David Center for Nursing and Rehabilitation for leave to intervene as a respondent in the proceeding and to extend the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, and King David Center for Nursing and Rehabilitation is granted leave to intervene as a respondent in the proceeding; and it is further,

ORDERED that on or before February 26, 2021, the petitioner and the respondent Howard Zucker shall submit corrected covers for any copies of the record and briefs filed with the Clerk of this Court, which contain captions that designate King David Center for Nursing and Rehabilitation as a respondent, and upload replacement digital copies of the record and the briefs through the digital portal on this Court's website which contain the corrected covers; and it is further,

ORDERED that the time of King David Center for Nursing and Rehabilitation to serve and file a brief is extended, and on or before February 26, 2021, King David Center for Nursing and Rehabilitation shall serve a brief and upload a digital coy of the brief, with proof of service thereof, through the digital portal on this Court's website, and file an original and five hard copies of the brief in accordance with any applicable administrative order or other order to be issued by the Court.
