| DECISION & ORDER ON MOTION |
Appeal and cross appeal from an order of the Supreme Court, Kings County, dated June 28, 2019 and an appeal from an order of the same court dated May 28, 2020. Motion by the respondents-appellants to strike the joint appendix on the ground that it is inadequate, in effect, to enlarge the record to include certain material, and to extend the time to serve and file an answering brief, including the points of argument on the cross appeal (see 22 NYCRR 1250.9[f][1][iv]).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to extend the time to serve and file an answering brief is granted, the respondents-appellants' time to serve and file an answering brief is extended, and on or before March 8, 2021, the respondents-appellants shall serve the answering brief and upload a digital copy of the answering brief, with proof of service thereof, through the digital portal on this Court's website, and file an original and five hard copies of the answering brief in accordance with any applicable administrative order or other order to be issued by the Court; and it is further,
ORDERED that the motion is otherwise denied.
