DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Dutchess County, rendered February 13, 2018. Application by the appellant to extend the time to comply with a decision and order on motion of this Court dated December 16, 2020.

Upon the papers filed in support of the application, it is

ORDERED that the application is granted and the decision and order on motion of this Court dated December 16, 2020, is amended by deleting from the third decretal paragraph thereof the date "January 6, 2021," and substituting therefor the date "February 23, 2021"; and it is further,

ORDERED that the appellant shall serve a copy of this decision and order on motion upon court reporter Jessica Bartolini at the same time and in the same manner as the appellant serves the decision and order on motion of this Court dated December 16, 2020, and the 60-day period for court reporter Jessica Bartolini to serve upon the attorney for the appellant the transcripts of the proceedings of jury selection and trial does not begin until service of both this decision and order on motion and the decision and order on motion of this Court dated December 16, 2020, has occurred.
