DECISION & ORDER ON MOTION

Proceeding pursuant to CPLR article 78 in the nature of mandamus to compel the respondent Timothy J. Dufficy, a Justice of the Supreme Court, Queens County, to determine a motion purportedly filed by the petitioner in a proceeding entitled Matter of Johnson v Ryan, commenced in that court under Index No. 005085/2019, and application by the petitioner for poor person relief, which was determined by decision, order and judgment of this Court dated November 12, 2020. Motion by the petitioner for leave to appeal to the Court of Appeals from the decision, order and judgment of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
